Zoning ordinance update

The miscellaneous issues ordinance is an annual ordinance to resolve discrepancies and improve the clarity of those sections of the City Code that relate to land development and zoning. Items included will typically be minor amendments that may not on their own merit the overhead of drafting, reviewing, publishing and hearing an ordinance.

Changes proposed in 2012

  • Deleting fee references (2.13);
  • Modifying care of refuse standards (10.05);
  • Modifying and clarifying noise source requirements (10.29.02);
  • Modifying notice requirements for grass, weed and brush orders (10.39);
  • Adding setback standard restricting swimming pool drainage (11.31);
  • Modifying code section reference for disorderly house definition (12.01.01);
  • Modifying property conditions constituting public nuisance (12.03);
  • Modifying public assembly prohibitions (14.67);
  • Modifying enforcement responsibility and notice requirements for multiple dwelling maintenance standards (14.503);
  • Modifying single or two family dwelling completion of work extension requirements (15.201);
  • Establishing temporary stockpile standards (12.03, 15.202);
  • Clarifying certificate of occupancy issuance linked to Minnesota State Building Code requirements (15.04, 19.26);
  • Clarifying order to treat or remove diseased trees (18.04);
  • Adding definition for manufactured homes and deleting obsolete reference to mobile homes (19.03, 19.28, 19.28.01, 19.44, 19.50.03);
  • Adding temporary storage unit or container definition and standards (19.03, 19.50.02);
  • Clarifying recreational equipment prohibited in residential district front yard (19.08);
  • Deleting retail business as a conditional use in the Freeway Development district, FD-1, FD-2 (19.34);
  • Modifying criteria and duration requirements for special events and entertainment events, in the Commercial-Office Mixed-Use district, CO-2, and the Mixed Use district, CX-2, and deleting expired provision for short-term storage and parking the Commercial Office Mixed Use district, CO-2 (19.40.08.01, 21.207.01);
  • Modifying temporary sign regulations and fees (19.118; 19.119; 19.127; 21.502.01);
  • Clarifying and adding exterior lighting standards (21.301.07);
  • Modifying City Code section reference to Final Development plans (21.501.03).
  • Thereby amending Chapters 2, 10, 11, 12, 14, 15, 18, 19 and 21 of the City Code."
