Smokefree ordinances and resourcesState ordinance to ban smoking at all indoor public places![]() As of October 1, 2007, smoking is banned in all indoor public places and indoor places of employment under The Freedom to Breathe (FTB) provisions of the Minnesota Clean Indoor Air Act (MCIAA). The provisions describe where smoking is prohibited, the responsibilities of proprietors, and facilities and circumstances that are exempt.
Bloomington ordinancesCity Council action on Construction of Smoking SheltersOn December 19, 2005, the City Council adopted an ordinance establishing Standards for the Construction and Use of Smoking Shelters. The ordinance permits smoking shelters to be located in the rear or side yards no closer than 25 feet from entrances, exits, open windows or ventilation intakes of public places or workplaces and having a maximum size of 200 square feet and a maximum height to 16 feet. It prohibits the service or consumption of food and beverages in smoking shelters. The ordinance also permits receptacles for depositing extinguished tobacco products to be placed within 25 feet of building entrances. In passing the ordinance, the Council adopted an amendment which adds language indicating the availability of a variance application process relating to the location and size of a smoking shelter. During the discussion, the City Manager pointed out that the changes Hennepin County made to their no-smoking ordinance will not affect Bloomington businesses.
